VyStar Foundation is a nonprofit 501(c)(3) created to spearhead community engagement and giving (“Services”). All donations solicited on behalf of VyStar Foundation shall be used to further our mission.

VyStar Foundation is committed to respecting the privacy of our donors. We have developed this Donor Privacy Policy (this “Donor Privacy Policy”) to provide you more information regarding our collection and data practices involving the Personal Information (as defined in our VyStar Foundation Privacy Policy) you provide as part of a donation to VyStar Foundation (the “Donation Services”). VyStar Foundation maintains the highest level of integrity and respect for the privacy of our donors. We seek to ensure that donors have trust and confidence in our practices.

This Donor Privacy Policy (“Policy”) forms a part of our VyStar Foundation Privacy Statement and further describes the collection, use and disclosure of all Personal Information received via Donation Services to VyStar Foundation (“Donor Information”), both online and offline, on any platform, and electronic, written or oral communications.

Please read this Policy before accessing or using the Donation Services. If you cannot agree with this Policy, then please do not provide us with any Donor Information.

1. Information We Collect

VyStar Foundation ("we," "us," or "our") collects and maintains the below Donor Information when using the Donation Services:

  • Contact Information. This includes name, email address, phone number, and other contact methods you provide to us.

  • Donation Information. This includes gift amount, date of gift, any gift restrictions requested by the donor.

  • Financial Information. This includes payment and financial information provided to enable the donation. We may collect your payment information when you make a contribution, either on our website, over the phone, at an event or by mailing in a check. However, credit card numbers are used only for donation or payment processing and are not retained for other purposes.

  • Event Analytics. This includes information on events attended, publications received, any special requests for program information.

  • Email, message & other communications between us. This includes records and copies of your correspondences (including email addresses) if you contact us.

Our Donation Services allow you to provide us with Donor Information relating to other parties. For example, our third-party donation platform may allow you to make a donation on behalf of family and friends, therefore providing us access to Donor Information such as names and email addresses of your family and friends (collectively, “Third-Party Data”). If you provide Third-Party Data to us, you acknowledge, represent, and agree (a) that you have the authority of the relevant other party for us to access and use the relevant Third-Party Data, and (b) that you have notified these other parties and informed them how their information is collected and used by us. We reserve the right to identify you as the person who made the donation on behalf of that third party. We use Third-Party Data in the same manner as described below.

We may also receive Personal Information from third-party fundraiser providers regarding any donations provided via fundraising platforms on those third-party services. Any information provided to such third-party fundraising platforms will be subject to the third-party’s terms and privacy policy. Our use of this Personal Information will be in accordance with this Donor Privacy Policy.

2. Use of Your Donor Information

All Donor Information is confidential and kept on file for IRS purposes, state record retention regulations, and legitimate business needs. VyStar Foundation will use confidential Donor Information for the following purposes:

  • Distributing donation receipts.

  • Sending thank you letters to donors.

  • Informing donors of VyStar Foundation news and events.

  • Internal analysis and record keeping.

  • Contacting donors about changes in policy.

  • Analyzing giving patterns to make accurate budget projections.

  • Protect against potential fraud, including verifying with third parties the information collected while processing a gift.

  • Publicly recognize donors by publishing names in our annual financial report, on our website and in other publications, unless a donor explicitly requests to remain anonymous. Donors may contact us as described in the Contacting Us section below to request that they not be included in such publications.

3. Disclosure of Your Donor Information

Except as otherwise described in this Donor Privacy Policy and our VyStar Foundation Privacy Policy, we will not disclose your Donor Information. We will not sell Donor Information that we collect from the Donation Services to any third party for monetary or other valuable consideration, unless notice has been provided and only with your consent:

  • Affiliates. We may share your Personal Information with our affiliated companies and organizations (“entities”) for the purposes described in this Policy, including for each such entity’s marketing purposes.

  • Service Providers & Contractors. To help us provide services, your Donor Information may be shared with our service providers, contractors, and other third parties we use to support our business. Such third parties may help us with aspects of our business such as fraud prevention, providing customer service, maintaining and analyzing data, and sending customer communications on our behalf.

  • Donation Partners. To the extent any donations are processed through a third-party service provider, Donor Information will only be used for purposes necessary to process the donation. Currently, VyStar Foundation uses the Cybergrants and PayMentus platforms for online donations.   • In the Event of Merger, Sale, Divestitures, or Change of Control. We reserve the right to transfer Donor Information to a buyer or other successor in interest that acquires rights to that information as a result of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of us or substantially all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Donor Information held by us about you is among the assets transferred.

  • With Your Consent. We may share your Donor Information for other purposes pursuant to your consent or at your direction.

  • Other Disclosures. We may disclose your Donor Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) conform to legal requirements and comply with any court order, law, or legal process, including responding to any government, law enforcement, or regulatory request; (ii) enforce our Terms of Use, other agreements, including between you and us, and any other documents included or referenced therein (all of which are incorporated into and made a part of this Policy by reference); (iii) fulfill the purpose for which you provide it; (iv) detect, prevent, or otherwise address fraud or security issues; or (v) protect against harm to our, your, or third parties’ rights, property, or safety.
